Opposition Chief Raila Odinga Hospitalised in Dubai
Opposition and Orange Democratic Movement (ODM) party leader Raila Odinga is recuperating abroad.
The ODM party chief is in a Dubai hospital for “a minor surgical operation on his back” this is according to his elder brother and the East African Legislative Assembly (EALA) Member of Parliament (MP) Oburu Odinga.
According to the Mombasa County Governor Ali Hasan Joho, who is also the ODM Deputy Party Leader, expressed confidence that the former premier will be back on his feet in no time and return to the country.
The Mombasa County boss also stated that he had spoken to Mr. Odinga earlier in the morning and the AU High Representative for Infrastructure was in high spirits.
“This morning I had the opportunity to speak to my party leader. I feel happy and encouraged that he’s progressing really well. So for us as a people, more importantly the fraternity of ODM, we continue to pray for our leader,” said Joho.
“I have no doubt that within the shortest time possible, Baba will be back in Kenya. So ours is to continue to stay strong, to pray for him. He has undergone a procedure, let us not forget that even our leaders are still human beings; some times they have to be sick and get treated, some times they have to deal with the issues that every human being goes through.”
He further added that: “I want to tell our supporters that our leader is strong, our leader is solid, he is recovering well, and soon he shall land back in Kenya and continue with the journey of ensuring we achieve our agenda of uniting the people of Kenya.”
Governor Waiguru Survives Impeachment
Kirinyaga Governor Ann Waiguru was left off the hook by being acquitted by the Senate Select Committee appointed to probe impeachment charges leveled against her.
According to the 11-member Committee chaired by Kakamega Senator Cleophas Malala, the County Assembly did not provide evidence directly linking her to alleged corruption, abuse of office and violation of procurement regulations.
“The Committee having investigated the matter in accordance with its mandate under section 33(4) of the County Governments Act and standing order 75(2) of the Senate Standing Orders reports to the Senate that it finds that the two Charges against the Governor have not been substantiated,” concludes the Committee.
According to the comitee, the County Assembly did not substantiate allegations that Waiguru failed to deliver the annual State of the county address for the Financial year 2018/2019 to the County Assembly and that she undermined the authority of the County Assembly.
“From the evidence adduced before the Committee, the Governor demonstrated that two Annual State of the County Address was made. One albeit was not delivered in the County Assembly. The Committee further noted that there is no county legislation to provide for the content of the Annual State of the County Address as required by section 30(2)(k) of the County Government Act,” reads the report.
On the allegation of violating procurement regulations, the committee noted that from evidence adduced before it, there was a clear mismanagement of some tenders, but they were not linked to Waiguru thus recommenced that the DCI and EACC delve deeper into the allegations, and using their forensic expertise, identify culprits for prosecution.
“Of the 12 tenders listed in the Motion, the County Assembly only prosecuted four of them. Of the four tenders prosecuted, the Committee notes that there was clear mismanagement of the tender process where tenders were awarded to Companies whose bids were not responsive or where there were clear cases of conflict of interest,” adds the committee.
“In the circumstances, the Committee recommends that investigatory authorities undertake investigations on the same and the culpable officers including the respective Tender Evaluation Committee members be called to account.”
The Committee further pointed out that Governor Waiguru discounted allegations by the County Assembly that she pocketed allowances for foreign trips that she did not travel.
According to the committee, the Governor adduced evidence of the travel and where travel was not undertaken, the imprest was surrendered though out of time. While this was an offence, according to the committee, it did not amount to an impeachable offence.
On violation of the Right to Health of the people of Kirinyaga county, the committee established that there were significant systemic problems in the health sector in Kirinyaga but recommended the issues be addressed as soon as possible by the various organs including the County Assembly and National Government institutions.
“The Committee further notes the high turn-over of health workers in Kirinyaga County and the inordinate delay in the payment of health workers who pursuant to the Governor’s moratorium, resumed work. This issue should be addressed forthwith. The Committee finds that this allegation was not proved and is therefore not substantiated,” added the report.
ANC Expels Cleophas Malala
The governing council of the Amani National Congress (ANC) on Friday approved the expulsion of Kakamega Senator Cleophas Malala from the party.
The party’s disciplinary committee had in November last year suspended and summoned Senator Malala to appear and respond to charges made against him during an Orange Democratic Movement (ODM) party rally.
“The committee finds and holds that your utterances and activities at the political rally convened by the Orange Democratic Movement (ODM) at Kibra on October 27, 2019 prejudiced the integrity and reputation of the ANC party and its members and employees,” read resolution of the disciplinary committee.
Senator Malala however failed to respond to the charges and refused to appear before the committee to defend himself hence their decision to expel him.
“After careful consideration of the penalties set out in Article 50.9 of the Constitution of Amani National Congress party the committee resolved to expel you from membership of ANC with effect from December 5, 2019.”
NGC unanimously adopted the disciplinary committee’s resolutions.
Contacted, Malala laughed off the matter saying he will issue a comprehensive statement later responding to the matter..
“I have a great matter before me. I will address that issue later,” he said on phone.
The senator has been chairing the Senate committee on Kirinyaga Governor Anne Waiguru’s impeachment and will table the findings before a special sitting of the Senate on Friday 2.30 pm.
Malala and ANC leadership has been on warpath following the senator’s stand especially on the Building Bridges Initiative which has seen him publicly differing with Mudavadi.
The lawmaker also abandoned the party last year when he declared support for a rival candidate in the Kibra by-elections where the ODM party won.
The NGC meeting also resolved to adopt a new party Constitution and extended the term of office for all party officials.
“This special meeting of the National Governing Council have full cognisant of the peculiarity of our present Covid-19 induced situation hereby ratify and adopts the resolution of NEC postponing the holding of elections pending the easing of covid-19 and as a consequence resolve to extend the tenure of the current office bearers,” the Friday morning resolved.
Speaking to Star, nominated MP Godfrey Osotsi who has been demanding elections in the party said the resolutions are null and avoid as the NGC was not properly convened.
“This is a political joke of the year and an exercise in futility. I am confident that the Registrar of Political Parties shall not entertain such political fraud by people who profess to be protectors of rule of law,” he said.
