Kenya’s ex-International David Obuya Stops Cricket Kenya Elections
The High Court has stopped the forthcoming Cricket Kenya (CK) national elections scheduled for April 19, 2026 in Nairobi.
The court issued the orders in a petitioned filed under a certificate of urgency by Kenya’s national team player, coach and a duly nominated aspirant for the position of Vice Chairperson of Cricket Kenya David Obuya together with a stakeholder Juliana Kathure.
High Court Judge Lady Justice Roselyn Aburili sitting at the Milimani Law Courts issued conservatory orders restraining Cricket Kenya and the sports body’s Chief Executive Officer (CEO) Ronald Bukusi from organizing and conducting the polls.
Bukusi is further stopped from performing any executive functions, issuing notices or coordinating any electoral processes for Cricket Kenya.
The Sports Registrar, Attorney General (AG), Cricket Kenya, Bukusi and the Independent and Boundaries Commission (IEBC) who have been jointly sued respondents have been given 7 days to file and serve their responses thereto. The petitioners/applicants will have 7 days of the date of service to file and serve their rejoinder if need arises.
In their affidavits, Obuya and Kathure said the electoral process is currently marred by fundamental constitutional illegalities, including the use of conflicting voter registers and the systematic exclusion of legitimate delegates from registered counties.
“The integrity of the electoral process has been compromised by the introduction of dual, conflicting voter registers. A comparative analysis between the "Official Delegates List" issued by the Sports Registrar and the list published for the April 19, 2026 elections reveals systemic discrepancies. Legitimate county delegates from associations duly registered by the Sports Registrar are being physically barred and arbitrarily excluded from voting venues,” read the petition.
They said that there is currently no legally recognized Independent Electoral Panel (IEP) to oversee the upcoming elections. The panel has not been ratified by the Cricket Kenya Council in accordance with the governing statutes.
The petitioners said Bukusi whose contractual tenure has expired and who is on active suspension for gross misconduct, is illegally spearheading the election process in blatant defiance of the Rule of Law and administrative directives.
In the petition, they said that Obuya who is a candidate for the position of Vice Chair, is suffering extreme prejudice as he is unable to campaign or verify the electorate due to the deliberate and active concealment of the official delegates list.
