Wiper Party leader Kalonzo Musyoka has been granted orders barring the government from entering concession agreements with Adani Group over Jomo Kenyatta International Airport (JKIA) until a pending case is determined.
Kalonzo was granted the orders by Justice Bahati Mwamuye sitting at the High Court in Nairobi.
Kalonzo representing Tony Gachoka, Mt. Kenya Jurists, Wiper Party, Democratic Action of Party (DAP-K) and Jubilee Party led other senior counsels including Kibe Mungai, Eugene Wamalwa, Dan Maanzo, and Ndegwa Njiru who sought court orders to halt the JKIA takeover by Adani.
The judge in his ruling, prohibited Adani from taking over management and assets at Jomo Kenyatta International Airport (JKIA).
The court further directed the cabinet secretary treasury, the ministry of roads, the management of JKIA, and the Kenya Airports Authority, not to enforce the said private initiated partnership.
The Court ordered government to table evidence to substantiate the cancellation of the contentious deal with Adani, which President William Ruto announced during the State of the Nation address on Thursday, November 21.
Last Sunday, Kalonzo revealed that he will be moving to court to seek directives compelling the government to shed more light on what the Indian company contract cancellation means.
Speaking during a church service at Jesus Teaching Ministry in Embakasi East Constituency, Nairobi, Kalonzo announced that he would be personally moving to court after the cancellation left some gaps.
According to the former Vice President, should the court grant the orders compelling the government to act on his petition, then Kenyans will get the chance to hear how the government benefitted from the engagement with Adani.
”We have work to do now and we will not just be talking here and there, for example, we will be moving to the courts on November 27, so that we can get directions on what William Ruto’s cancellations mean,’’ Kalonzo declared.
Kalonzo added that their petition will seek to answer some of the questions Kenyans had raised in the past over the much interest that the government had invested in the deal.
”We are going to get them exposed. Let us pray that all the wrongdoings of the country will be put open and in the public so that every thief can be known for the nation’s complete healing,’’ he added.
