Azimio Stopped from Removing Fatuma Dullo as Senate Minority Whip

The Political Parties Dispute Tribunal (PPDT) has stopped the Azimio La Umoja One Kenya coalition from removing Isiolo Senator Fatuma Dullo as the minority whip in the Senate.

The Desma Nungo-led tribunal further stopped the coalition from removing other members of the Jubilee party from parliamentary committees.

Kilifi Senator Stewart Madzayo who is the Minority Leader of Azimio, Narok Senator Ledama Olekina who replaced Dullo and the Speaker of the National Assembly have been named as interested parties in the suit filed by Dullo and Jubilee Party.

Dullo and Jubilee party claim they are being condemned without being heard contrary to the principles of natural justice and if the same is not stopped by the Tribunal, her purported removal will be communicated to the Senate in blatant disregard of lawful procedures.

“The Proceedings and Resolution of the Respondent’s Parliamentary Group are likely to be actualized before the anomalies and illegalities of the said removal process are addressed and unless stopped by this Honourable Tribunal,” Dullo argued in the court documents.

The tribunal issued the temporary orders and directed the matter to be mentioned on February 28, 2023 for compliance and further directions.

“Pending inter partes hearing and determination of the application, interim orders of injunction are hereby issued restraining the Respondent and Interested Parties either by themselves, their servants, agents and/or any other persons acting on their behest from implementing the communication and resolution by the Respondent’s Parliamentary Group meeting held on February 14 2023 purporting to remove Fatuma Dullo and other members of the Jubilee Party from the position of Senate Minority Whip and Parliamentary Committees and its attendant privileges respectively,” the order by the tribunal read.
